Sales Tax Election Postponement

ORDER TO MOVE ELECTION TO BE HELD MAY 2, 2020 ON THE PROPOSITION
OF AUTHORIZING AN ADDITIONAL ONE-HALF PERCENT (0.5%) SALES TAX IN
MONTGOMERY COUNTY EMERGENCY SERVICES DISTRICT NO. 8 PURSUANT
TO HEALTH & SAFETY CODE §775.0751 AND §775.0752 TO NOVEMBER 3, 2020
WHEREAS, MONTGOMERY COUNTY EMERGENCY SERVICES DISTRICT NO.8 (the "District") operates pursuant to Texas Constitution, Article III, § 48-e, and Chapter 775,
Health & Safety Code; and
WHEREAS, The District had ordered an election to be held on May 2, 2020; and
WHEREAS, On March 13, 2020 Greg Abbott, the Governor of the State of Texas,declared a state of disaster due to the globally recognized contagious respiratory virus, COVID-
WHEREAS, On March 18, 2020 Governor Greg Abbott issued a proclamation “to allow political subdivisions that would otherwise hold elections on May 2, 2020, to move their general
and special elections for 2020 only to the next uniform election date, occurring on November 3, 2020”; and
WHEREAS, due to current circumstances, the District has elected to move the election ordered for May 2, 2020 to November 3, 2020; and
WHEREAS, Election Day for the November election is November 3, 2020. The vote registration deadline is October 5, 2020. The deadline for eligible voters to submit an
application for ballot by mail is October 23, 2020. Early voting will take place from October 19 through October 30, 2020.
NOW, THEREFORE, IT IS HEREBY ORDERED that the May 2, 2020 Election in Montgomery County Emergency Service District No. 1 ordered by the District be moved to
November 3, 2020.
IT IS FURTHER ORDERED that:
1. That all actions taken thus far in the preparation of the Election be held and applied towards the November election as appropriate.
2. All valid applications submitted by voters who are voting by mail due to being over the age of 65 or due disability will still be valid for the November 3, 2020 election.
Applications to vote by mail by voters who submitted a ballot by mail application based on an expected absence from the county during the May 2, 2020 election will not be valid for the
November 3, 2020 election. Voters who expect to be absent from the county during the November 3, 2020 election may request a ballot by mail.
3. That details regarding the November election will be set forth in a separate order for Election for the November election.
4. In accordance with all applicable Federal and State law, there shall be provided Spanish translation of the ballot as well as other applicable election materials.
ADOPTED at Open Meeting this the 23rd day of March, 2020, by a vote of 4 to 0.
